Welcome to Limelight. Please read these Terms of Use ("Terms") carefully before using the Limelight mobile application ("App") operated by Jordan Kennedy, a sole proprietor ("we," "us," "our").

By downloading, accessing, or using Limelight, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country, and able to form a binding contract, to use the App.
Using Limelight requires a free account with The Movie Database (TMDB), and an Apple ID to download the App and manage any subscription.

2. License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with these Terms and the Apple Media Services Terms and Conditions.
Except where this restriction is prohibited by law, you may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the App.

3. Use of Service

Limelight provides information about books, movies, and TV shows, including streaming availability and content details.
The App is provided "as is" and we make no warranties about the completeness, reliability, or accuracy of content information.
You agree to use the App only for lawful purposes and in accordance with these Terms.

4. Subscriptions (Limelight+)

Limelight offers an optional auto-renewable subscription, Limelight+, that unlocks premium features. Core discovery and tracking remain free.
Subscriptions are sold and billed by Apple through your Apple ID at the price shown at the time of purchase. Payment is charged on confirmation of purchase.
Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
If a free trial is offered and you purchase a subscription, any unused portion of the trial is forfeited.
You can manage your subscription, turn off auto-renewal, or cancel at any time in your Apple ID account settings. Refunds, where applicable, are handled by Apple under the App Store's terms.
Purchases are tied to your Apple ID and can be restored on your devices.

5. Acceptable Use

When using Limelight, you agree not to:

use the App for any unlawful purpose or in violation of these Terms;
submit through SceneSnap any content that is unlawful, infringing, or that you do not have the right to submit;
attempt to interfere with, disrupt, overload, or gain unauthorized access to the App or any systems or networks it relies on;
scrape, harvest, or misuse data from the App, or use it to build a competing product;
use the App in any way that could harm us, other users, or any third-party service the App depends on.

6. AI Services and Content Analysis

The App uses Google's Gemini API ("AI Services") to power the SceneSnap feature, which identifies movies, shows, and actors from a photo, screenshot, or video you submit.
By using SceneSnap, you acknowledge that the media you submit is sent to and processed by Google's Gemini API.
Content submitted through SceneSnap is subject to Google's own data-retention and privacy policies, which we encourage you to review at policies.google.com.
While we strive for accurate analysis, AI-generated results may not always be perfect or complete, and we do not guarantee the accuracy, completeness, or reliability of any AI-generated content or analysis.

7. Privacy and Data Collection

Limelight is built privacy-first: it shows no advertisements, sells no data, and contains no in-app analytics or tracking.
Using Limelight requires signing in with your own account with The Movie Database (TMDB); your library is stored in your TMDB account, not on a Limelight server.
The only data shared with third parties is your library (with TMDB, when you're signed in) and the photo or video you submit to SceneSnap (with Google, for analysis); Limelight+ purchases are processed by Apple. We never share your data with advertisers or data brokers.
Our website uses PostHog for anonymous analytics, configured with cookies and IP address collection disabled. No personally identifiable information is collected through this service.

8. Intellectual Property

The App, including its original content, features, and functionality, is owned by Jordan Kennedy and is protected by copyright, trademark, and other intellectual property laws.
You may not modify, distribute, sell, or exploit any portion of the App without our prior written consent.
Movie, TV, and related data and images are provided by The Movie Database (TMDB) and other third parties and remain the property of their respective owners. This product uses the TMDB API but is not endorsed or certified by TMDB.

9. Third-Party Content and Services

The App provides information about content available on third-party streaming services and platforms.
We are not responsible for the accuracy of third-party content information or the availability of content on streaming platforms.
Links to third-party services are provided for convenience only. We have no control over, and assume no responsibility for, third-party content, policies, or practices.

10. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or secure, or that content information, streaming availability, ratings, or AI-generated results will be accurate or complete.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising from your use of or inability to use the App.
To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid for the App and its subscriptions in the twelve months before the claim, or twenty-five U.S. dollars.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Jordan Kennedy from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms, or your violation of any law or third-party right.

13. Apple App Store Terms

Because the App is distributed through the Apple App Store, the following also apply:

These Terms are between you and Jordan Kennedy only, not with Apple, and Apple is not responsible for the App or its content.
Your license to use the App is a non-transferable license to use it on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
Apple has no obligation to provide any maintenance or support for the App. We, not Apple, are solely responsible for any support we choose to offer.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
We, not Apple, are responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, and consumer protection claims, and any claim that the App infringes a third party's intellectual property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not listed on any U.S. Government restricted-parties list.
You must comply with any applicable third-party terms when using the App (for example, the terms of TMDB and Apple).
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you.

14. Changes and Updates

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time without notice.
We may update these Terms from time to time. Continued use of the App after any changes constitutes acceptance of the updated Terms.

15. Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice, for any reason including breach of these Terms.
You may stop using the App at any time. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

16. Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-laws principles.
Any disputes relating to these Terms or your use of the App will be subject to the exclusive jurisdiction of the state and federal courts located in Tennessee, except where applicable law gives you the right to bring a claim in your local courts.
